Johnson//Becker, PLLC, attorney Adam J. Kress filed this complaint on behalf of Mr. Gregory Townsend, a resident of California, alleging that Mr. Townsend was severely burned after his vape battery exploded in his front right pants pocket. Consequently, his clothing caught fire, resulting in catastrophic injuries to his thigh and hand.
According to the complaint the batteries, marketed, sold, and distributed by EightVape may not be fit to be used in e-cigarettes, rather, Mr. Townsend alleges that these are “cells” to be used by sophisticated battery packers that utilize proper circuit protection. According to a recent article concerning the case, the “EightVape device had a battery that was too powerful for the casing in which it was embedded.”
Lithium-ion batteries are commonly used in e-cigarettes and vapes due to potentially improper marketing from distributors, posing a possible risk of fire and explosion.
