Johnson//Becker, PLLC is a nationwide FLSA law firm with extensive experience representing employees in lawsuits against employers who fail to compensate workers in accordance with federal and state laws. The firm has recovered millions of dollars in settlements for affected employees.
Johnson//Becker filed a lawsuit against RxC Acquisition Company and Does 1-10 alleging that the company failed to compensate their employees according to the Fair Labor Standards Act (FLSA). The lawsuit was filed on Oct. 16, 2023, on behalf of Ms. Donna Hernandez.
RxC Acquisition Company connects patients to drug therapies on behalf of pharmaceutical company clients, enrolling patients in copay assistance plans or pharmacy voucher programs. The company operates a call center that answers customer calls from its clients’ patients. The majority of the workforce at RxC Acquisition Company’s call center consists of staffing placements from the company Does 1-10.
According to the Complaint, Ms. Hernandez regularly worked over 40 hours per workweek, which included conducting boot-up and call-ready work. Before she could take calls from clients at her regularly scheduled shift start time, Ms. Hernandez was required to boot up the computer and computer applications to make herself call-ready. The Complaint also alleges that the boot-up and call-ready work regularly takes up to 10 minutes per shift, sometimes more if technical issues arise.
Federal law mandates that work performed over 40 hours in a workweek must be compensated for at one and one-half times the employee’s regular pay rate.
A resident of Peoria, Arizona, Ms. Hernandez is represented by Johnson//Becker lawyers Jacob R. Rusch and Zackary S. Kaylor. Mr. Kaylor and Mr. Rusch have extensive experience handling plaintiff’s employment law cases, focusing on collective actions under the Fair Labor Standards Act.
