Johnson//Becker, PLLC is a nationwide FLSA law firm with extensive experience representing employees in lawsuits against employers who fail to compensate workers in accordance with federal and state laws. The firm has recovered millions of dollars in settlements for affected employees.
Johnson//Becker filed a lawsuit against Advocate Health & Hospitals Corporation, alleging that the company violated the Fair Labor Standards Act (FLSA). The lawsuit was filed on Oct. 13, 2023, on behalf of client Ms. Carmen English.
Defendant Advocate Health & Hospitals is a non-profit corporation in Illinois that is the largest health system in the state. The company’s call center answers patient calls and provides scheduling services for medical appointments, including scheduling appointments and tests, entering patient data, completing questionnaires, providing arrival instructions, and resolving issues.
According to the Complaint. Ms. English regularly worked over 40 hours per workweek, which included boot-up and call-ready duties before the start of her shift. Before Ms. English could take her first call, she had to turn on her computer, enter credentials, and log in to multiple computer programs, servers, and applications.
The Complaint also alleges that Defendant did not compensate Ms. English for her unpaid boot-up and call-ready work hours.
Federal law mandates that work performed over 40 hours in a workweek must be compensated for at one and one-half times the employee’s regular rate of pay.
A resident of Berwyn, Illinois, Ms. English is represented by Johnson//Becker lawyers Zackary S. Kaylor and Jacob R. Rusch. Mr. Rusch and Mr. Kaylor have extensive experience handling plaintiff’s employment law cases, focusing on collective actions under the Fair Labor Standards Act.
