AI Data Center Lawsuit

Understanding the AI Data Center Lawsuits

The use of Generative AI has surged over the past five years, driving investments by prospective tech companies seeking to take advantage of the AI bubble. As a result, we have witnessed the rapid development of AI data centers, with the number of centers expected to triple by 2030. However, this swift expansion has raised concerns by nearby residents who claim to be experiencing costly consequences. Some homeowners are finding an increased difficulty in their efforts to sell their homes given their proximity to these AI data centers, which emits loud, continuous noise. Further, the constant noise produced by AI data centers has caused the value of nearby properties to decrease. Those who remain nearby, as sourced from the “National Association of Realtors” state that property owners may be seeing a drastic increase in their residential electricity rates as well as a result of the energy used to run an AI data center. Others have claimed to experience diminished enjoyment in their outdoor spaces due to the persistent noise emitted by the facilities.

  • Lawsuits against AI data centers have quickly begun emerging across the country as the AI data boom continues. According to Local Memphis News, citizens in Mississippi filed suit in September 2026 related to an AI data center in Southaven. Plaintiffs stated that once the Southaven AI data center was operational, residents have been subject to loud noise, persistent rumbling, whining, and low-frequency vibrations 24 hours a day, every day. This continuous noise, and the stigma of living near a facility that produces such noise, has caused a loss in the value of residents’ properties and made it harder to sell their homes.
  • Memphis Action News 5 quoted these plaintiffs living near the Tennessee-Mississippi who are currently suing Elon Musks xAI that they had experienced “non-stop industrial roar [that] has shattered the quiet suburban character of their communities, causing severe sleep deprivation, chronic migraines, anxiety, and tinnitus (ringing in the ears). Many residents report being unable to use outdoor yards, open windows, or rest comfortably inside their own homes.”
  • Similarly, citizens in New Jersey filed suit regarding an AI data center located within one mile of their residences, claiming that the AI data center emits frequent and recurrent noise, resulting in a loss in the value of these resident’s homes.
  • Concerns over noise pollution have been longstanding. The Environmental and Energy Study Institute cited complaints from individuals in Brittany Heights of Chandler, Arizona, who, from their statements, have been suffering from the alleged noise pollution from a data center that moved into the neighborhood in 2014. “Residents living around the data center complained of a constant humming noise coming from the facility that never stopped, even at night. They tried blocking the acoustic nuisance with noise-cancelling headphones and earplugs, to no avail.”
  • Residents near AI data centers also may face increased electricity bills due to the energy used by the data center. According to the National Association of Realtors, residential electricity rates climbed 21.4% from 2020-2024 in counties with 10 or more data centers, compared to counties without data centers that only saw a 15.7% increase in rates.

What are AI Data Centers?

An AI data center is a large-scale facility that contains specialized computers, servers, high performance graphics processing units, strong and secure networking and IT infrastructure needed to train, develop, and deliver AI services on a wide scale basis.

There are claims that we are experiencing what may be referred to as an AI boom – where businesses work to outcompete one another to become the stronghold in a growing industry. Cleanview’s Data Center Tracker states that there are currently 1319 operating data centers in the US alone, with 2,248 projects that are planned for the future.

How Do AI Data Centers Cause Harm?

AI data centers can be the cause of consistent, and often, loud noise. The sound may stem from a complex mixture of their cooling systems and fans, generators, and servers. The tones and vibrations may be present upwards of 24 hours a day, and can cause disruptions to sleep patterns, enjoyment of the outdoors, and the quiet that residents are entitled. This constant noise and sometimes accompanying vibration can prevent the ordinary use and enjoyment of residents’ indoor and outdoor living spaces. Consequentially, the noise and vibrations from AI data centers have diminished the value of residents’ property.
